By accessing or using the GymOS platform ("Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all visitors, users, and subscribers of the Service.

2. The GymOS Service

GymOS is an all-in-one gym management platform that provides tools for managing members, memberships, payments, leads, attendance, automation, and business reporting. We reserve the right to modify, update, or discontinue any part of the Service at any time without prior notice.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update your information as needed. You must notify us immediately of any unauthorized use of your account.

4. Subscription & Payments

The GymOS Pro plan is available for ₹999 per month. We offer a 21-day free trial with no credit card required to get started. You may cancel your subscription at any time through your account settings, with no cancellation fees. All subscriptions include guided onboarding to help you set up the platform for your gym.

Payments are processed securely through third-party payment processors. By subscribing, you authorize us to charge your selected payment method on a recurring basis until you cancel your subscription.

5. Acceptable Use

You agree not to use the Service for any unlawful purpose, or in any way that could damage, disable, or impair the Service. You may not use the Service to store or transmit any malicious code, spam, or content that violates the rights of others. We reserve the right to terminate or suspend your account for violations of these Terms.

6. User Data & Privacy

You retain full ownership of all data you input into the GymOS platform, including member and business data. Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We will not share, sell, or disclose your business or member data to third parties without your explicit consent, except as required by law.

7. Service Availability

We strive to maintain 99% uptime for the Service, but we do not guarantee uninterrupted access. We may schedule maintenance windows, perform updates, or experience unforeseen outages. We will not be liable for any loss, damage, or inconvenience resulting from Service unavailability.

8. Intellectual Property

The GymOS platform, including all content, features, and functionality, is owned by GymOS and is protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our explicit written permission.

9. Third-Party Services

The Service may integrate with or contain links to third-party services, including payment processors, SMS/WhatsApp providers, and analytics tools. These third-party services are governed by their own terms and privacy policies. We are not responsible for the practices or content of any third-party services.

10. Termination

You may cancel your subscription at any time. We reserve the right to suspend or terminate your account immediately, without prior notice, for any violation of these Terms or for any other reason we deem necessary to protect the Service or other users. Upon termination, your right to use the Service will immediately cease.

11. Limitation of Liability

To the fullest extent permitted by law, GymOS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

12. Changes to Terms

We reserve the right to update or modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
